Terms of Service

These Terms of Service ("Terms") govern your use of the HabBarGains mobile application (the "App"), operated by HabBarGains ("we," "us," or "our"). By downloading, accessing, or using the App, you agree to be bound by these Terms. If you do not agree, do not use the App.

1. Eligibility

You must be at least 17 years old to use the App. By using the App, you represent that you meet this requirement and, if applicable, that any account information you provide is accurate.

2. The Service

HabBarGains generates personalized strength and calisthenics training programs using AI, tracks your workouts, and provides an AI coaching chat. You can use core features as a guest (with data stored only on your device) or by creating an account (which syncs your data to our servers). Some features described in the App may be provided by AI systems — see Section 6.

3. Accounts

You are responsible for maintaining the confidentiality of your account credentials and for all activity under your account. You can delete your account at any time from the App's profile screen; deletion is immediate and permanently removes your data as described in our Privacy Policy.

4. Purchases

The App offers two distinct kinds of paid offerings, purchased through different systems:

• In-app digital products(e.g. purchasable training programs) are purchased through Apple's In-App Purchase system and billed to your Apple ID. These purchases are subject to Apple's own terms and refund policies — refunds for in-app purchases must be requested through Apple, not from us directly.
• Coaching services that involve a real human coach (form checks, ongoing coaching subscriptions, 1-on-1 coaching, and skill-mastery programs with video feedback) are real-world services delivered outside the App and are purchased separately through our payment processor, Stripe, via links the App opens in your browser. These are governed by the terms and refund policy shown on the payment page at the time of purchase, and by any communication with your coach. Prices are shown in the App and on the payment page before you pay. We may change prices for future purchases at any time; changes do not affect purchases you've already made.

5. User Content

You retain ownership of any content you submit — progress photos, workout notes, video submitted for a form check, and messages to the AI coach. By submitting a form-check video or similar content to a human coach, you grant us and that coach the limited right to view and use it solely to provide the service you purchased. Progress photos are private to your account and are never shared or used for any other purpose without your consent.

6. AI-Generated Content and Fitness Disclaimer

Training programs, exercise information, and AI coach responses in the App are generated by an AI system and are provided for informational and educational purposes only. They are not medical advice, and following them is at your own risk. AI-generated content can be inaccurate or unsuitable for your specific circumstances. Consult a physician before starting any new exercise program, especially if you have a pre-existing condition, injury, or health concern, and stop immediately if you experience pain, dizziness, or discomfort.

7. Acceptable Use

You agree not to:

• Use the App for any unlawful purpose or in violation of these Terms.
• Attempt to reverse-engineer, decompile, or gain unauthorized access to the App or its backend systems.
• Interfere with or disrupt the App's servers or networks.
• Impersonate another person or misrepresent your affiliation with any person or entity.

8. Intellectual Property

The App, including its design, code, exercise library, and branding, is owned by HabBarGains and protected by intellectual property laws. We grant you a limited, non-exclusive, non-transferable license to use the App for your personal, non-commercial use.

9. Termination

We may suspend or terminate your access to the App at any time if we believe you have violated these Terms. You may stop using the App and delete your account at any time.

10. Disclaimer of Warranties

The App is provided "as is" and "as available," without warranties of any kind, express or implied. We do not guarantee the App will be uninterrupted, error-free, or that any training program will produce specific results.

11. Limitation of Liability

To the fullest extent permitted by law, HabBarGains is not liable for any indirect, incidental, special, or consequential damages arising from your use of the App, including injury sustained while following a training program. Our total liability for any claim related to the App will not exceed the amount you paid us, if any, in the 12 months before the claim arose.

12. Changes to These Terms

We may update these Terms from time to time. We will notify you of significant changes by posting the updated Terms on this page and updating the "Last updated" date. Continued use of the App after changes constitutes acceptance of the updated Terms.
